1. HOURLY RATE WORK. The total charge to the Customer shall consist of the cost of materials supplied by Quantum Electricians and Plumbers (not exceeding the trade purchase price of materials + 40%) & the amount of time spent by the engineer in carrying out the work (this includes all reasonable time spent in obtaining unstocked materials) charged in accordance with our hourly rates. The Customer shall only be charged for the time spent related to the Customer’s work, all other time, personal mobile calls etc. is non-chargeable. All charges are subject to VAT.
(i) Unless by prior instruction from the Customer there is no cap to the number of hours Quantum has to reasonably spend in executing any hourly work. Unless informed otherwise Quantum will endeavour to proceed with any work originally instructed by the Customer. (ii)The Customer shall be updated should the works appear to be protracted in nature and can cancell any further works with immediate effect. (iii) the fiscal responsibility of the Customer will not exceed any cost incurred by the engagment of Quantum in carrying out its work up to that point including any sunk costs.
2. FIXED PRICE WORK shall be given as a total cost, (manifest errors exempted) including Labour & Materials. The cost is strictly reflective of the scope of works detailed in writing in the estimate. Works carried out not defined in the scope are charged as additional work. Additional works are only carried out when the Customer instructs the engineer or company in writing or verbally.
3. Where a written estimate has been supplied to the Customer the total charge to the Customer referred to in the estimate should not exceed the actual time taken by more than 20% but may be revised in the following circumstances:—
(i) if after submission of the estimate the Customer instructs the Company (whether orally or in writing) to carry out additional works not referred to in the estimate.
(ii) if after submission of the estimate there is an increase in the price of materials.
(iii) if after submission of the estimate it is discovered that further works need to be carried out which were not anticipated when the estimate was prepared . (iv) if after submission of the estimate it is discovered that there was a manifest error when the estimate was prepared.
4. PAYMENT TERMS: All invoices are payable upon receipt. Unless manifestly stated in writing and agreed prior to the commencement of any work
a)All our Invoices are due to be paid in full immediately. This will be on completion of our visit.
b)You are solely responsible to retrieve our invoice and make provision to pay it in such a way that coincides with the timing of our visit and terms of payment.
c)You accept full liability for any delays in payment of our invoice.
d)Any further work required is by separate arrangement.
e)You do not have the right to withhold any payment to us unless we have agreed to this in writing with you. This does not supersede English Law.
f) We reserve the absolute right to request deposits and upfront payments at our discretion.
Quantum does not advance credit unless special terms have been agreed in writing prior to works starting.
d)Invoices unpaid are liable to carry a charge of 4% interest above base rate for all days overdue. We retain the right to add a late payment fee of £25 to all late payments.
5. CANCELLATIONS: All cancellations by the customer will incur the total loss of any deposit paid. In the case of a booking being cancelled by the Customer with no more than 24 hours notice given then 1 hour charge is applied by Quantum Electricians and Plumbers to the Customer. This cost is non refundable. If you cancel you will be liable for any handling charges, delivery charges associated with your cancellation.
6.MATERIALS COLLECTION. Collection of non-stock items is chargeable but:
(a) Time must be kept to a minimum & reasonable.
(b) If the collection time is likely to exceed 1 hour the customer must be additionally informed of the circumstances.
(c) Only one engineer is allowed to leave the job to collect parts.
7. GUARANTEE
Quantum is committed to delivering a professional service. Our guarantee is active from the date of when the works were conducted to 12 months after. If you believe a fault has occurred in our workmanship or parts we have supplied you must provide us with written notification within 12 months of the date of when the guarantee was activated. The guarantee provided by Quantum is limited to work done by Quantum only.
a)The guarantee will be rendered void if any person except a recognised representative of Quantum interferes with the work carried out by us after we have finished.
b)The guarantee does not cover consumable parts.
c)In claiming the guarantee Quantum will endeavour to respond as soon as possible but current working commitments will dictate Quantum's response time. You must allow us reasonable time to respond to you.
d)Reasonable time to respond to you is defined as a minimum of 2 working days excluding weekends and public holidays. We retain the right to a reasonable extension of this time if prevailing circumstances require such.
e)We will make every effort to expediently resolve your issues related to our guarantee but take no liability for delays imposed by the delivery of parts or where the complex nature of the issue dictates that protracted time is required to resolve the problem.
f)You must allow us and our insurers the opportunity to both inspect the work and carry out remedial work where appropriate. If you fail to notify us or our insurers of any issues resulting from our services then we will not be liable for any resulting claims.
WHAT IS NOT COVERED BY OUR GUARANTEE
a)We do not guarantee work in respect of blockages of waste and drainage systems.
b) Any faults non related to the work directly undertaken by us.
c) Where we have agreed to carry out work on inferior installations and old installations, more than 10 years of age, we cannot guarantee the effectiveness of such work
d) where we have recommended further works or further investigation required or provided advice on any further action required and you have not instructed Quantum to proceed accordingly then we accept no liability for any faults subsequently occurring.
Guarantee On Repair Work
Guarantees are limited exclusively to the repair work only that has been done by Quantum. We accept no liability for further issues that are attributable to different components, different causes, the general condition / design of the installation or its manor of use.
a)When we have conducted a repair on an existing installation and that repair has proved to be inadequate and it has since become evident that further escalated repair work is required we will accept no liability for any further works.
8. LIABILITY
Quantum shall not be liable for any delay or for the consequences of any delay in performing any of its obligations if such delay is due to any cause whatsoever beyond its reasonable control.
a)Quantum shall be entitled to a reasonable extension of time for performing such obligations.
b)We will not be held liable or responsible for any damages or defect resulting from work not fully guaranteed or where recommended work has not been carried out by us.
c)We accept no liability for issues resulting from other items that were overlooked or were not apparent to us at the time our services were delivered.
d)You will be solely liable for any hazardous situation in respect of
f)Where we are compelled under a duty of care to switch off, isolate or make safe an installation until appropriate remedial work can be implemented you accept full liability for the situation.
g)Where we have been required to make safe under a duty of care or conform to prevailing regulations we accept no liability for the loss of any services, inconvenience caused, associated costs - direct and indirect, or any claims resulting from this action.
h)We accept no liability for any claims borne out of delays in the completion of any remedial works
9. TITLE TO GOODS
a)All goods supplied and delivered by us to you remain our property until paid for in full by you. We retain the absolute authority to
The risk of such goods will pass to you once we have delivered them to you. You accept liability for their safe keeping. You must insure them at their replacement value and produce evidence of appropriate insurance to us should we request it. You will be responsible for any loss, damage or theft of our goods after they have been delivered to you.
10. GENERAL
These terms and conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by a duly authorised representative and you. Our terms and conditions will prevail over any terms and conditions used by you or contained, set out or referred to in any documentation sent to us by you. By entering into a contract with us you agree irrevocably to waive the application of any of these terms and conditions.
These terms and conditions, and all contracts awarded between us and you, shall be governed and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English law.
